Ruling

The accused was charged with assault with weapon following an investigation by the Children's Aid Society (CAS) into whether he was physically abusing his children. The accused made incriminating statements to a CAS worker during the investigation that the Crown wished to introduce into evidence against him. The Court excluded the evidence as the workers' notes were incomplete summaries of what was said by the accused and would not provide a full and complete explanation for the trier of fact.
