Legal Aid Ontario is a provincially funded and regulated program that offers legal assistance to people who cannot afford to hire a lawyer. In the criminal law context, sometimes an Accused person may not have the funds to hire a defence lawyer to represent him in court. If this is the case, an Accused can apply to Legal Aid Ontario to pay for their lawyer. If the Accused meets all the financial and legal criteria required by Legal Aid Ontario, the Accused person will be granted a legal aid certificate. The Accused person can then choose a lawyer to represent him on his criminal case in court as long as the lawyer agrees to accept Legal Aid as a retainer for the case. There is no requirement that a lawyer accept a legal aid certificate. It is up to the lawyer as to whether legal aid will be accepted as a retainer or not. Our firm will often accept cases with a legal aid retainer in Toronto, the GTA and other locations in Ontario.
