The accused lived in a three bedroom apartment with his common law partner and six children. The accused was charged with sexual assault, incest and sexual exploitation over a six year period in relation to the accused's daughter. The accused was acquitted. There was not sufficient supportive evidence to prove beyond a reasonable doubt that the events described by the daughter happened, as the daughter's evidence contained several improbabilities and inconsistencies, such as claim that assaults happened in various rooms of tiny apartment while other family members were present.
