Ruling
Accused was arrested, taken to police station and interviewed for one hour on videotape. The videotape was then turned off and the officers left the room to obtain handcuffs to escort the accused to the cells. The accused allegedly resisted and assaulted the officers. The accused was also at time bound by a probation order to keep peace. The accused was subsequently charged with two counts of assault police and with a breach of probation. The accused was convicted as the Court ruled the evidence did not leave any doubt that the accused committed the assault.
