Possession of Stolen Property, as defined under Section 354 of the Criminal Code, involves possessing items known or suspected to be stolen. This hybrid offence can lead to severe penalties, depending on whether the Crown proceeds by indictment or summary conviction.
Possession of Stolen Property, as defined in section 354 of the Criminal Code, applies if you purchase or acquire items that are stolen or that you should have reasonably suspected were likely stolen. Being in possession of an item acquired through theft is a criminal offence.
Possession of property obtained by crime is a hybrid offence. This means that the Crown can choose to proceed with the charge either by indictment or by summary conviction. If convicted of an indictable offence, you will face more severe penalties than if sentenced for a summary conviction.
