Mischief Under $5000

Mischief Under $5000 is a Canadian criminal offence that involves damaging, destroying, or interfering with someone else’s property without their permission. It is usually considered a less serious crime than more serious offences such as theft, assault, or aggravated assault. The maximum penalty for Mischief Under $5000 is two years in jail and/or a fine of up to $5,000.


  • If the Crown proceeds by summary conviction: the maximum punishment is a fine of not more than $5000 or a term of imprisonment of not more than two years less a day, or both.
  • If the Crown proceeds by indictment: the maximum punishment is a term of imprisonment not exceeding two years.
