Incest

Incest, defined under Section 155 of the Criminal Code, involves sexual intercourse with a blood relative, with knowledge of the relationship. It is a straight indictable offence with a maximum penalty of 14 years and a minimum of 5 years if the other person is under 16.


Incest, as defined in section 155 of the Criminal Code, occurs when an individual has sexual intercourse with a blood relation. For the offence to be made out, the individual must have knowledge of their blood relationship with the other person (i.e., a parent, child, brother, sister, half-brother, half-sister, grandparent, or grandchild, as the case may be).

Incest is a straight indictable offence with a maximum penalty of not more than 14 years. If the other person is under the age of 16 years, the minimum penalty is imprisonment for a term of five years.
