Invitation to sexual touching, as defined in section 152 of the Criminal Code, occurs when a person invites, counsels, or incites a minor (under the age of 16) to touch them for sexual purposes. For the purposes of this offence, “touching” can be direct or indirect and can include touching either with a part of their body or an object.
Invitation to sexual touching is a hybrid offence. This means that the Crown can choose to proceed with the charge either by indictment or by summary conviction. If convicted of an indictable offence, you will face more severe penalties than if sentenced for a summary conviction.
