Sexual Exploitation

Sexual exploitation, defined under Section 153 of the Criminal Code, involves sexual activity by a person in authority with a young person, even with apparent consent. As a hybrid offence, it can result in significant penalties depending on how the Crown proceeds.


The offence of sexual exploitation, as defined in section 153 of the Criminal Code, occurs when a person in a position of authority or trust towards a young person engages in sexual activity with the young person, even if there is apparent consent.

Sexual exploitation is a hybrid offence. This means that the Crown can choose to proceed with the charge either by indictment or by summary conviction. If convicted of an indictable offence, you will face more severe penalties than if sentenced for a summary conviction.
