Can I be charged with arson if it was accidental?
If the fire or explosion was accidental, and the accused can demonstrate that they did not intentionally or recklessly cause damage to property as a result of the fire or explosion, a defence may be available. The Crown must prove that the accused knew the consequences of their actions and chose to act anyway.
