What happens if I violate my probation in Canada?
If you violate your probation, you may face new criminal charges. The offence of failure to comply with a probation order is found at section 733.1(1) of the
Criminal Code
. Anyone found guilty of failing to comply with a probation order, without reasonable excuse, may be found guilty of either 1) an indictable offence and is liable to imprisonment for a maximum term of four years; or 2) an offence punishable on summary conviction.
