What if the Child Pornography was deleted?

In some cases, destruction of child pornography may give rise to an “innocent possession defence.” This defence may be available where it can be shown that a person only intended to possess contraband for the purpose of turning it over to authorities, destroying it, or placing it permanently out one’s control [see e.g. R v Chalk, 2007 ONCA 815 at para 24].
